It's time for the right to move on from the term "Rule of Law." What that phrase actually implies is "Rule of Lawyers," which is exactly the institutional framework that was set up by Pierre Trudeau when he deliberately crafted our Constitution as a recipe for shifting decision-making away from Parliament and into the hands of unelected bureaucrats, who are protected in their efforts to subvert individual liberty by an increasingly activist judiciary, all under the guise of "Rule of Law."
What we need to focus on instead is the preservation of our rights in the face of this institutional and bureaucratic creep. Much more importantly, and this is a real problem in Canada, we need a common basis upon which to build communities that are as state-proof as possible.
